إنَّه وفقًا لتعديلات قانون الشهر العقاري الجديد الذي سيتمّ تطبيقه خلال أيام، لن يتمّ الاعتراف بالعقود الابتدائية، والعقود التي تمّ أخذ حكم بصحة التوقيع عليها، مؤكّدًا أنَّه لن يتمّ الاعتراف أو التعامل الحكومي بدخول المرافق وغيرها سوى بالعقود المسجلة في الشهر العقاري حيث سيتمّ العمل بهذا القرار بداية من 4 مارس المقبل أي بعد 15 يومًا.،،،،،
★ وأكّدت المصادر "، أنَّه في حالة شراء عقار بعد تاريخ 4 مارس 2021 لن يتمّ نقل عددات المياه والكهرباء والغاز والتليفون أو إدخال هذه المرافق إلى العقار إلا بعد أن يتمّ تسجيل عقد البيع بالشهر العقاري، حيث لن يكتفي بحكم صحة ونفاذ عقد البيع دون تسجيله.
★ وتابعت المصادر : «أما فيما يخص العقود التي تمّ شراؤها قبل هذا التاريخ، فلن يتمّ اتخاذ أي إجراء لهذه الوحدة إلا بعد تسجيلها في الشهر العقاري».
★ وأكّدت المصادر أنَّه في حالة تسلسل الملكية للوحدة السكنية أو العقار سيضطر صاحبها لرفع دعوى صحة ونفاذ، أما فيه حال انتقال ملكية الوحدة أو العقار عن طريق الميراث فيجب إشهار حق الأرث ولن يتمّ الاعتداد بإعلام الوراثة فقط.
★ كما سينطبق القرار على الأراضي غير المسجلة في الشهر العقاري، حيث سيتمّ رفض استخراج أي تراخيص دون تسجيل العقد في الشهر العقاري.
★ وناشدت المصادر المواطنين بعد شراء عقارات مخالف لأنَّه سيواجهون صعوبة في تسجيلها بالشهر العقاري بعد هذه التعديلات.
